Terms of Service

1. Acceptance of these terms

Randomly Brandy is operated by Randomly Brandy(“we,” “us,” or “our”). By browsing the site, creating an account, or placing an order, you agree to these Terms of Service and to our Privacy Policy, Returns & Exchanges Policy, and Shop Policies, which are all part of this agreement. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may only use the site with the involvement and consent of a parent or legal guardian who agrees to be bound by these terms.

3. Your account

You may check out with an account. You are responsible for keeping your login details secure and for all activity under your account. Please give us accurate, current information — especially your email and shipping address, since we use them to fulfill and update you about your order. Tell us promptly if you believe your account has been used without your permission.

4. Our products

We sell handmade and made-to-order goods — including apparel, drinkware, blankets, and 3D-printed items — as well as ready-made stock. Because many items are crafted by hand and to order, small natural variations are normal and expected: slight differences in placement, texture, color, and finish from one piece to the next are part of a handmade product, not a defect.

We try to show every product accurately, but colors can look different from screen to screen and material to material. Product images are for illustration and the item you receive may vary slightly in shade or texture. Sizes and measurements are approximate.

5. Custom & personalized orders

Some items are personalized with names, text, images, or designs you provide. For those orders:

• You confirm that you own, or have permission to use, any text, image, logo, artwork, or other content you send us, and that our making your item will not infringe anyone’s intellectual property, publicity, or other rights.
• You agree not to submit content that is unlawful, infringing, hateful, obscene, or that we reasonably consider offensive. We may decline or cancel any custom request at our discretion, and will refund a declined custom order that we have not yet started.
• You are responsible for the spelling, dates, and details you provide. Please proof them carefully — we make items as ordered, and errors in the details you supply are not eligible for a free remake.
• You indemnify us against any claim arising from content you provide for a custom order (see section 12).

Because personalized items are made specifically for you, they are final sale except where they arrive damaged, defective, or not as ordered. See our Returns & Exchanges Policy.

6. Placing an order

Adding an item to your cart or submitting payment is an offer to buy. A contract is formed only when we accept your order — normally when we begin making or preparing it for shipment. Until then we may decline or cancel an order for any lawful reason, including if an item is out of stock, a price or description was clearly wrong, we cannot verify payment, or we suspect fraud or abuse. If we cancel a paid order before fulfilling it, we will refund what you paid for that order.

7. Prices, taxes & payment

Prices are shown in the currency displayed at checkout and may change over time, but the price that applies to your order is the one shown when you place it. You are responsible for any applicable sales or other taxes, which may be added at checkout. Payments are processed securely by Stripe; we do not store your full card number. By paying, you authorize the charge for your order total, including shipping and tax. See our Shop Policies for when payment is captured.

8. Shipping & risk of loss

Production and shipping timelines, carriers, and delivery areas are described in our Shop Policies. Delivery estimates are estimates, not guarantees, and carrier delays are outside our control. Risk of loss passes to you when the carrier takes possession of your package — but if an item arrives damaged in transit, we’ll make it right under our Returns & Exchanges Policy. You are responsible for giving us a correct, complete shipping address.

9. Returns, exchanges & refunds

In short: we do not offer refunds simply because you changed your mind. We offer exchanges on eligible variation items (such as a different size or color) and replacements for items that arrive damaged in transit or are defective or incorrect. Refunds are issued only when we cannot fulfill, replace, or exchange your item. Where a resolution requires the item to come back, we provide a prepaid return label; outbound shipping on an exchange or replacement is free, the return-label cost is yours unless we waive it, and any refund tied to a return is issued once we receive the item. For an exchange, if the original item is not returned within 60 days of us sending the replacement, we may charge the card on file for the un-returned item. 10. Our intellectual property

The Randomly Brandy name, logo, site design, text, product photography, and our original designs are owned by us or our licensors and are protected by law. Buying a product does not transfer any rights in our underlying designs or brand. You may not copy, resell, or reproduce our designs, photos, or content for commercial use without our written permission.

11. Acceptable use

You agree not to:

• use the site for any unlawful or fraudulent purpose;
• interfere with, probe, or disrupt the site, its security, or other users;
• scrape, harvest, or copy content or data except as ordinarily needed to browse and shop; or
• submit false information or impersonate another person.

12. Disclaimers

The site and our products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties we have not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits any rights you have under mandatory consumer-protection laws that cannot legally be waived.

13. Limitation of liability

To the fullest extent permitted by law, Randomly Brandy will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the site or your purchase. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some jurisdictions do not allow these limits, so they may not fully apply to you.

14. Indemnification

You agree to indemnify and hold harmless Randomly Brandy from any claims, damages, or costs (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, or any content you submit for a custom order.

15. Governing law & disputes

These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be handled by the courts located in the State of New Jersey, United States, except where applicable law entitles you to bring a claim elsewhere. We encourage you to contact us first at support@randomlybrandy.com so we can try to resolve any concern directly.

16. Changes to these terms

We may update these terms from time to time. The version in effect when you place an order governs that order. We’ll update the “last updated” date above when we make changes, and significant changes may be highlighted on the site. Continuing to use the site after a change means you accept the updated terms.
